Dream Cosmetics vrs The Registrar of Trademarks
Our client, Dream Cosmetics, desired to register the mark ‘MISS’. A search conducted at the Ghana Intellectual Property Office revealed that the mark ‘MISS’ had already been registered by another company. However, the mark had remained unused for more than five (5) years and had not been renewed. Accordingly, we applied on our client’s behalf to the Registrar of Trademarks to remove the dormant mark from the Trademark Register and register the mark in our client’s name per section 14 of the Trademark Act 2004 (Act 664).
The Registrar refused our client’s application and did not change her decision when we opposed same. Consequently, we appealed the Registrar’s decision at the High Court.
The court ordered the Registrar to clean up the Trademark Register and proceed with the due process to register our client’s mark.
